1.Definitions and documents
"Service" means the Callfora website, web and mobile applications, desktop applications, APIs, and related services. "Workspace" means your organization's account. "Customer data" means the content you or your users put into the service, including calls, recordings, messages, contacts, files, meeting content, and AI agent conversations.
These terms include the Acceptable use policy, AI agents terms, Billing, cancellation, and refunds, Data processing addendum, Subprocessors list, Privacy policy, and Emergency calling notice. If documents conflict, a signed order form prevails, then the Data processing addendum for personal data, then these terms, then the other policies.
2.The service
Callfora provides cloud business phone, business SMS, meetings, team chat, contact-center tools, analytics, AI agents, and an API, as included in the plan you choose. Features depend on your plan, enabled modules, permissions, and configuration.
Phone numbers and carrier services are available in the United States. Do not use the service to serve other countries without our written agreement, because telecom rules differ by country. See the Compliance overview.
3.Accounts and eligibility
The service is for businesses and professionals, not consumers or children. The person who signs up must be authorised to bind the organization.
You are responsible for your users, their credentials, the permissions you grant, and all activity in your workspace. Keep sign-in details secure and tell us promptly about unauthorised use. Give accurate business and identity information; carriers and regulators require it to assign numbers, register messaging, and port numbers.
4.Telecom services and phone numbers
Calling and messaging over the public telephone network are delivered by licensed carrier partners. We are not a carrier in every country, and carrier terms, registrations, and filtering decisions can affect delivery.
Numbers are assigned to you for as long as your account is in good standing. We may need to reclaim or change a number when a carrier or regulator requires it. You can port numbers out, subject to carrier rules, while your account is active and paid.
5.Emergency calling
Internet-based calling has limitations for emergency services. Read and accept the Emergency calling notice, and make sure every user knows its limits. You agree to keep an alternative way to reach emergency services.
6.Acceptable use and compliance
You must follow the Acceptable use policy and the laws that apply to your calls and messages, including consent, call recording notice, telemarketing, do-not-call, and anti-spam rules. You are responsible for telling callers when calls are recorded or handled by an AI agent where the law requires it.
You are the one who decides whom you contact and why. We provide tools; we do not review your lists, scripts, or recordings in advance.
7.AI agents and automated features
AI agents, summaries, transcripts, and insights are generated by software and can be wrong. You are responsible for reviewing outputs before relying on them and for the AI agents terms, including disclosure to callers and a path to a human.
8.Fees, taxes, and billing
Fees are per licensed seat plus phone numbers and any usage shown at checkout, billed in advance for the term you choose. Usage beyond included allowances, such as AI agent minutes, is charged at the rates shown in the service. Taxes are extra and added where required, including Indian GST for customers in India. The Billing, cancellation, and refunds page forms part of these terms.
9.Customer data
You own your customer data. You give us the rights we need to host, process, transmit, and display it to provide the service. We do not sell customer data and we do not use it to train our own AI models.
Our Data processing addendum applies to personal data we process on your behalf. You are responsible for having the legal basis, notices, and consents needed to put personal data into the service and to record, transcribe, and analyse communications.
10.Our intellectual property
We and our licensors own the service, its software, and its brand. We grant you a limited, non-exclusive, non-transferable right to use the service during your term. Do not copy, resell, reverse engineer, or build a competing service from it. Feedback you give us may be used without restriction. The Callfora name and logo are trademarks of Vedatra Scalable Stacks Private Limited.
11.Confidentiality
Each party will protect the other's non-public information with at least reasonable care and use it only for the agreement, except where the law requires disclosure.
12.Availability and support
We work to keep the service available and to fix problems quickly, but we do not promise uninterrupted service unless we have signed a separate service-level agreement with you. Calls and messages depend on internet connections, devices, and third-party carriers outside our control.
13.Warranties and disclaimers
We will provide the service with reasonable skill and care. Except as stated in these terms and to the extent the law allows, the service is provided as is and we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
14.Indemnity
You will defend and compensate us against third-party claims and regulatory penalties arising from your customer data, your instructions, or your breach of the Acceptable use policy or the law, including claims about consent, recording, or messaging. We will defend you against third-party claims that the service as we provide it infringes their intellectual property rights, subject to your prompt notice and cooperation.
15.Liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or lost data, and our total liability in any 12 months is limited to the fees you paid us in that period. Nothing limits liability that the law does not allow to be limited.
16.Suspension and termination
We may suspend the service if fees are overdue, if your use breaks these terms or the law, or if it threatens the security of the service or carriers. You can cancel at any time as described on the Billing page. You can request an export of your data within 30 days after termination. After that we delete it as described in the Data processing addendum.
17.Export controls and sanctions
You will not use the service in breach of applicable export-control or sanctions laws, or allow anyone in a sanctioned country or on a sanctions list to use it.
18.Governing law and disputes
These terms are governed by the laws of India. The courts at Bengaluru, India have exclusive jurisdiction, unless a signed agreement says otherwise. Before starting formal proceedings, each party will try in good faith to resolve the dispute through written notice and discussion for 30 days. Mandatory consumer or data protection rights that cannot be waived under the law of your country are not affected.
19.General
These terms and the documents they include are the whole agreement. If a provision is unenforceable the rest stays in force. You may not assign the agreement without our consent, except to a successor of your whole business. Neither party is liable for delays caused by events beyond its reasonable control. Notices to you may be sent to the email address of your workspace owner; notices to us go to the contact below.
20.Changes
We may update these terms. We will give at least 30 days' notice of material changes by email or in the service. Using the service after the effective date means you accept the update.
